Securities litigation is an area that has seen a significant uptick in activity in the UK recently, with an increasing number of Section 90 and Schedule 10A FSMA claims being brought in the English courts. This follows the hand down of the liability judgment in HP/Autonomy v Lynch & Hussain
in May 2022 – the first section 90A/Schedule 10A FSMA claim to have been considered at a full trial, with the judgment giving prospective claimants and litigators some clarity and confidence as to how the key features of such claims are to be addressed by the English courts.  But what does litigation of this nature actually look like in the UK, is it all that different to other types of mass claims, and how does it compare with the regimes in other jurisdictions, including the Netherlands?
