Sovereign states face a unique set of challenges in conducting litigation and arbitration, all the more so when claims are made in fraud. States and their adversaries typically have to deal with difficult legal issues including the question of authority of officials, conflict of laws, competing criminal investigations, privilege, state immunity and enforcement.
2023 saw a number of fraud claims involving states in courts and arbitral tribunals across the world, including of course the English courts. Join Peters & Peters and Serle Court Chambers over breakfast for a discussion of the issues facing states and their advisors when dealing with fraud claims involving states.
